A Last Will and Testament is a written document whereby a person’s wishes are set out, how his or her assets must be distributed upon his or her demise. Assets can consist of immovable property (houses, farms), movable property (furniture, vehicles, art, firearms, livestock etcetera) or incorporeal assets (shares, timeshare, member’s interest and so forth).
The need to have a Will upon our passing, cannot be overemphasized. At Heritage Estate Administrators we will draft a Will for you, for free (T&C applies) and store your original Will in our safe storage facility, at no costs. Our team consists of consultants who are duly qualified and trained to draft a Will which is compliant in terms of the Laws of the Republic of South Africa, and we will ensure that your final wishes are executed upon your demise.
A Will can be drafted and amended to a maximum of five amendments. The Last Will and Testament will be drafted for free, provided that Heritage Estate Administrators is nominated as the executor of the estate, or co-executor or specifically nominated as the administrator agent in the Will.
If you do have a Will, it is important that you update your Will at least once a year. Change in lifestyles require that we update and amend our Will’s, as often as possible. These lifestyle changes can be as a result of:
- Starting your working career or new employment with different employment benefits, such as pension, or starting a new business.
- A change in your marital status – getting married or divorced.
- A change in your assets, such as purchasing a home or vehicle, and also taking into consideration your debt and how the debt will be paid in full upon your passing.
- The addition of new family members, including the birth or adoption of a child.
- Dependency of family members, especially those
with special needs or minor children. - Death of a family member or beneficiary in your Will, who can no longer benefit as a result of their passing.
